The President of the United States of America, Donald Trump has expressed his desire towards the implementation of a new immigration system based on merit last month.
The proposal was described in key points rather than a complete form. The president’s goal was brought out where the emphasis was laid on the reduction of immigration based on family and giving of green cards to younger, educated, and skilled immigrants.
Though the specifics were not mentioned, there is a similarity between the Immigration bill that was introduced in 2017 to the Senate by some senators – the RAISE Act and the President’s proposal. The Act was hailed by the president when it first got to the Senate; nonetheless, the rejection of the bill of the Congress led to its death.
The US immigration would have been reduced to almost half by the RAISE Act. Also, the Immigration system would have been points-based, capitalizing more on immigrants with advanced degrees and higher achievements.
In the proposed system of the RAISE Act, even though immigrants could score high points with US job offer, employers in the US may find it challenging to sponsor new or existing employs for a green card. The point value ultimately determines if an immigrant can secure a US permanent residence.
The Future of H-1B Visa
With Trump’s emphasis on the growth of very skilled foreign workers, it may be assumed that he envisions a large number of temporary work visas for highly skilled and educated foreign citizens. Nevertheless, neither the Act nor proposal has stated anything about the L-1 or H-1B visas which are temporary work visas.
With this, while waiting for Congress to pass a bill in the president’s proposal, an increase in the number of H-1B visas allocated in the future should not be expected by employers.
Also, since the president was elected, there has been a significant increase in the request for evidence for H-1B applications by the USCIS, showcasing the president’s goal to defend the workforce in America, as stipulated in his “Buy American, Hire American” executive order.
With this, employers should also note that processing time for the applications may take longer than before, and as such prepare towards that. It should also be noted that legal fees may be increased.
