Federal Authorities Say 2019 H-1B Lottery Favors Advanced-degree Holders

Compared to last year, there have been more selections of H-1B visa applications in the main lottery this year, for workers with higher degrees from colleges and universities in the US, as reported by the federal authorities. Concerning the President’s executive order “Buy American, Hire American), the lottery for this year was slightly modified for 65,000 H-1B visas for higher degrees holders from US institutions, by the agency. Also, extra 20,000 visas have also been provided for the same workers in the lottery, under a process related to the first, making it 85,000 H-1B visas allocated daily. According to the USCIS, the percentage of selected applications of advanced degree holders this year in the 65,000 visa lottery is 65% compared to the 56% observed last year. Also, about 201,000 applications were drawn for this year’s 85,000 visa lottery, and most of the applicants are holders of advanced degrees from US institutions.

The Increment does not change the rules

According to the spokeswoman, Jessica Collins, the agency is bent on executing the President’s executive order, ensuring that the visas are given merit-based. As well as the changes in the lottery allocation, other changes have also been made by the administration towards the reformation of the visa. The administration has increased the rate of visa denials and the request for more evidence for visa qualifications. Also, though it has been delayed a lot of time, there is a pledge by the administration to eliminate work authorization from about 90,000 H-1B holders’ spouses who are awaiting green cards. According to Barbara Wong, a Fermont immigration lawyer, even though those with master’s or higher degrees from a US institution have a higher chance of being picked for the H-1B lottery, getting a visa is not guaranteed. Also, the interpretation of degree qualifications for a job is also being narrowed by the Federal government. A lawyer at the Centre for Immigration Studies, John Miano said that the increased H-1B allocations are not significant and without meaning, to the American workers because foreign workers can still replace them.
